Violation Due Process
Lawn /Landscaping, Window AC Units, Trash, Vehicle Violations and Holiday Seasonal Decorations, etc. will receive a violation letter and will have 14 days to come into compliance. If the violation is not corrected within 14 days or reoccurs, the homeowner will be scheduled to appear before the Board of Directors. A Notice of Hearing, postmarked at least 14 days prior to such hearing will be sent by both Certified and regular US Mail, will result from violations not brought into compliance.
Property Maintenance Violations will result in a First Notice Letter with a compliance deadline of 30 days. If after 30 days the violation remains, a Notice of Hearing to appear before the Board of Directors will be sent to the homeowner. The Notice will be postmarked at least 14 days prior to such hearing and sent by both Certified and regular US Mail.
Once the violation is reviewed by the Board of Directors, the homeowner has an additional 15 days to correct or will be charged fines in accordance to the Virginia Property Owners Act (POA) and the Associations policies.
If the homeowner does not correct the violation and has reached the maximum fine amount allowed by the Virginia POA then their membership privileges (includes the Sports Pavilion, pools, voting rights) are suspended and their account is sent to the legal department for collections.
